Article 1 – Definitions

The following definitions apply in these terms and conditions:

  • Offer: Any written offer by Nosu for the delivery of Products.
  • Business: A natural or legal person acting in the exercise of a profession or business.
  • Consumer: A natural person not acting in the exercise of a profession or business.
  • Buyer: The Business or Consumer who enters into an Agreement with Nosu.
  • Agreement: The (distance) purchase agreement between Nosu and the Buyer.
Products: The supplements and related products offered by Nosu, aimed at managing blood sugar levels and supporting a healthy lifestyle.
  • Seller: Nosu as the provider of the Products.

Article 2 – Applicability

These terms and conditions apply to every Offer by Nosu, every Agreement between Nosu and a Buyer, and to every Product offered by Nosu. Deviations are only valid if agreed upon in writing. The Buyer’s general terms and conditions are explicitly rejected.

Article 3 – The Offer

Offers from Nosu are non-binding, unless stated otherwise in writing. If an Offer is limited or subject to conditions, this will be explicitly mentioned. Obvious errors or mistakes do not bind Nosu. Images and specifications are indicative and may differ.

Article 4 – Conclusion of the Agreement

The Agreement is concluded once the Buyer accepts an Offer from Nosu by paying for the Product. Nosu will confirm the Agreement in writing or by email. If the acceptance deviates from the Offer, Nosu is not bound by it.

Article 5 – Subscriptions

Nosu may offer subscriptions for its Products. If a subscription is concluded without direct debit authorization, it may be canceled immediately. For subscriptions with direct debit, cancellation must occur at least one week before the debit date.

Subscription Management (Pause or Cancel Anytime)

Nosu offers subscriptions for its Products to provide convenience and savings. Customers may pause or cancel their subscription at any time, subject to the conditions below.

1. Types of Billing

1.1 Subscriptions without Direct Debit Authorization

If a Customer subscribes using a payment method other than SEPA Direct Debit (e.g., credit card, PayPal, Apple Pay, iDEAL), no direct debit authorization is used.
• The Customer may cancel at any time, effective at the end of the current billing period.
• The Customer may pause at any time, which will suspend upcoming renewals and shipments until the Customer chooses to resume the subscription.
• No further charges will occur after cancellation or during a pause.

2. Subscriptions with Direct Debit Authorization (SEPA Direct Debit)

If a Customer subscribes using SEPA Direct Debit, a Direct Debit Mandate is created authorizing Nosu to automatically withdraw subscription payments from the Customer’s bank account.

Because SEPA Direct Debit requires advance payment notification:
• Cancellation must occur at least seven (7) days before the upcoming debit date to prevent the next charge.
• If cancellation happens later, it will take effect for the following billing period.
• Pausing must also be activated at least seven (7) days before the debit date to ensure the next scheduled debit is not processed.

During a pause, no charges are made and no products are shipped.

3. Effect of Pausing a Subscription
• Pausing temporarily suspends billing and shipments.
• The Customer may resume at any time via their account.
• Upon resuming, normal billing and shipping will restart automatically.
• Pausing does not cancel the subscription; it simply delays upcoming renewals.

4. Effect of Canceling a Subscription
• After cancellation, no future automatic charges will be made.
• The Customer retains access to subscription benefits until the end of the current billing cycle.
• To restart later, the Customer may initiate a new subscription at the then-current price and terms.

5. Renewal Cycles

Subscriptions renew automatically according to the interval selected at checkout (e.g., every 30 days, every 3 months, etc.), unless paused or canceled.

6. Changes to Subscription Terms

Nosu may update subscription terms from time to time. Any material changes will be communicated in advance. Customers may cancel before changes take effect.

Article 6 – Execution of the Agreement

Nosu will execute the Agreement to the best of its ability and knowledge. If necessary, Nosu may engage third parties. The Buyer must provide accurate information in a timely manner. Nosu is not liable for damage resulting from incomplete or incorrect data provided by the Buyer.

Article 7 – Delivery

Delivery is made to the address provided by the Buyer. Delivery times are indicative and not strict deadlines. If delivery is delayed, the Buyer will be informed as soon as possible.

Article 8 – Inspection and Complaints

The Buyer must inspect the Products immediately upon receipt and report any defects in writing within 14 days. Supplements with opened packaging cannot be returned.

Article 9 – Prices and Payment

All prices are in euros and include VAT, unless stated otherwise. Payment must be made in advance unless otherwise agreed. In case of late payment, the Buyer owes statutory interest and collection costs.

Article 10 – Retention of Ownership

Nosu retains ownership of the delivered Products until the Buyer has fulfilled all payment obligations in full.

Article 11 – Warranty and Liability

Nosu guarantees that the Products comply with the Agreement and legal requirements. Nosu is not liable for damage caused by incorrect use of the Products.

Article 12 – Force Majeure

Nosu is not liable if it cannot fulfill its obligations due to force majeure (such as natural disasters, strikes, or supply issues). In case of force majeure, Nosu may suspend or dissolve the Agreement without liability for damages.

Article 13 – Intellectual Property Rights

All intellectual property rights to Products and materials from Nosu remain with Nosu. It is not allowed to copy, use, or distribute them without written permission from Nosu.

Article 14 – Privacy and Data Protection

Nosu processes personal data in accordance with applicable laws. For more information, please see our privacy policy.
